Stabbing, shooting, punching. or any type of offensive contact inflicted upon another person will land the aggressor in serious legal trouble. Assault is the knowing or intentional infliction of bodily harm upon another. Aggravated assault is more serious than simple assault and usually involves some object used as a weapon and/or intent to cause serious bodily injury to the victim. The object doesn't have to be a knife or gun, but can be any object capable of causing serious bodily harm.
Weapons lead to more serious charges and increased jail time. There are often justifications or defenses for assaulting another person such as self-defense or trying to protect another person. Man Charged with Threatening Woman.
According to Pennsylvania statute ( 18 Pa.C.S. Section 2706) a person commits the crime of terroristic threats, if the suspect communicates, either directly or indirectly, a threat to commit any crime of violence with the intent to terrorize the victim. The suspect need not actually have present ability to commit the crime and the victim does not have to believe the threat will be carried out. The statute is designed to protect the victim from psychological distress. Spur of the moment threats arising from passionate anger may not be classified as a terroristic threat. The totality of the circumstances surrounding the alleged threat are considered by the court and jury in deciding guilt. Com. v. Reynolds, 835 A.2d 720 (Pa. Super. 2003).
