| Mid Valley's Alcohol Use Policy in Conflict with State Law |

| The Times-Tribune reports today that the Mid Valley School District's policy on bus drivers and alcohol use is different - and less strict - than state law permits. The conflict came to the fore recently after a driver was removed from his route while in transit when another adult in the vehicle smelled alcohol and intervened. School administrators responded to the scene but failed to notify law enforcement.
This is the second time in the past few months that a professional driver for the Mid Valley School District has been identified as drinking and driving while on the job, a fact that, combined with the district's apparent lack of knowledge as to state laws concerning the subject, has parents concerned and angry. The May 12th board meeting, at which the district's alcohol policy will be discussed, should be interesting.
Bus and van drivers in our state cannot consume any alcohol before operating their vehicle. Non-commercial drivers in Pennsylvania must not drive with a BAC greater than the state legal limit of 0.08. | The Times Leader reports that after a two-year investigation, a Hazleton man scheduled for trial next month for killing a 25-year-old woman in a DUI-related accident has pled guilty to the charges against him. At the time of the crash, the man was allegedly traveling at nearly 30 mph over the legal speed limit and had a blood alcohol content (BAC) of .14 percent.
In this case, no other cars were involved. Only the man and his passenger, the woman who was killed, were present. In DUI accidents more generally, the blame for the accident is almost always laid upon the drunk driver - if any driver in an accident involving more than one vehicle has a BAC of .08 percent or higher, law enforcement will assume that the accident is that driver's fault.

Most people know that driving under the influence of alcohol (DUI) is a crime. What few recognize, however, is that driving under the influence of drugs (DUID) is also a punishable Scranton, Pennsylvania DUI crime, as well as a crime in all 50 states.
How states structure their DUID laws varies. In some states, law enforcement and prosectors must demonstrate that your illicit drug use caused impairment in order to convict you of DUID. In other states, a blood test is used to determine whether you meet a predetermined per se standard for DUID; having a prescribed level of a drug or its metabolite in your system renders you guilty. Since toxicologists and researchers have not been able to agree on what constitutes appropriate per se levels, however, some states have enacted zero tolerance laws which make drivers with any amount of illicit drugs or their metabolites in their systems automatically guilty of DUID - you can be convicted even if you were sober at the time of your arrest.

OK, PA. Did you read the paper over the weekend? Did you catch the story about the man out near Punxatawney whom police arrested for public drunkenness because witnesses observed him trying to "raise" a "long-dead" opossum on the side of the road?
Apparently, the man tried both occult and scientific means during his rescue - one witness alleged that he was gesturing as if conducting a seance, another that he attempted to use mouth-to-mouth resuscitation on the animal. The Times-Tribune reported that a state trooper said the man was "extremely intoxicated." I guess so!
While the article made me laugh, drunkenness - and especially driving under the influence of alcohol (DUI) - is no laughing matter. DUI is a serious offense in PA, and anyone found to be operating a vehicle with a blood alcohol content (BAC) over the legal limit of .08% can be arrested and charged with drunk driving.

| Old Forge Gunman Arrested |

| The
Times-Tribune reports that Old Forge schools were shut down and several local roads closed this afternoon while police worked to apprehend an alleged gunman roaming in and out of the woods in a residential and business neighborhood near West Oak Street Cemetery.
Thank goodness, Old Forge pizza production appears to have remained unaffected.

| Economics, Education and Crime in Northeast Pennsylvania |

Today's Times-Tribune reports that at least ten preschools in Lackawanna, Wayne and Susquehanna counties have either remained closed or are on the verge of closing due to the state budget impasse.
The article also discusses new research which suggests that kids who attend preschool are only half as likely to wind up in prison as kids who do not.
The article then segues back to economics, with the Scranton Police Chief pointing out that, "It costs more today to have somebody in state prison than it costs to send someone to college at Penn State University for one year."
What struck me about this article was the seamlessness of the transition among the three topics: economics, education, crime.
If research showed that preschool made no difference - or worse yet - that former preschoolers inordinately comprised the prison population, then would we value education less? Does education have no inherent value?
Similarly, if the financial cost of imprisoning our young people remained less than the cost of college, then would we be happy to keep sending them to prison?
I fear we are becoming a culture in which the majority would say that education is only as important as the income it generates, and that the value of everything - even freedom - can be measured in dollars and cents.
That, to me, is as scary as the scariest crime statistic out there.

In this morning's Pocono Record, I saw that the organization is having an ongoing event at Borders in Stroudsburg. Through September 7th, customers can purchase books at the store and donate them in support of a local children's reading program.
This is just one service that the Kiwanis Club provides. Globally, the organization works with UNICEF to eliminate iron deficiency disorders, the leading preventable cause of mental retardation. Did you hear about the Scranton fugitive who was recently captured and is now facing multiple criminal charges?
Yesterday, parole agents captured Jonathon Waiters, a fugitive on the run, after he crashed into two vehicles in South Scranton while allegedly attempting to evade arrest for a parole violation. The Times-Tribune reported that Waiters is now charged with crimes including resisting arrest, accidents involving damage to an attended vehicle, driving under the influence, and drug possession.

In 2006, Hazleton made national news when it passed its Illegal Immigration Relief Act, a law that discouraged hiring and renting to undocumented immigrants. In Hazleton, this mostly meant Latinos; the law had a chilling impact on the Latino community, including its many members who are American citizens.
Support for the act was based partly on the city mayor's claim that murders and violent crimes had increased dramatically as a result of illegal immigration to the city.
However, evidence suggested that this claim was untrue. In fact, studies show that undocumented immigrants have extremely low incarceration rates, and that very few serious crimes committed in Hazleton were attributable to undocumented immigrants.
In 2007, a federal judge struck down the Illegal Immigration Relief Act. An appeal filed with a federal appeals court last fall is still awaiting a ruling. Latino residents throughout the region remain fearful for their safety and worried about the futures of their jobs, homes and businesses.

| Earlier this week, I wrote about Charlotte Lewis' bicycle accident in Scranton, PA.
I thought it might be helpful to follow up with additional information about Scranton, PA hit & run charges.

Many young people in northeast Pennsylvania make poor choices when it comes to drug and alcohol use. These choices can lead to criminal charges including drug possession, underage drinking and driving under the influence (DUI).
The Times-Tribune recently covered the Lackawanna County district attorney’s office reminder to local students to make good choices about drugs and alcohol this prom season. The Prom/Graduation Safety Fair at Genetti’s in Dickson City used humor and motivational speaking to encourage drug and alcohol prevention.
I applaud these efforts, as recent statistics from the U.S. Department of Health and Human Services Office of Applied Studies show that although young people who receive such messages are generally less likely to report recent use of drugs and alcohol, the percent of young people who receive these messages is declining.
As a result, many young people in northeast PA put themselves at risk for criminal charges. In fact, the 2005 Pennsylvania Youth Survey Report by the Pennsylvania Commission on Crime and Delinquency reveals that 44 % of Pennsylvania’s high school seniors report having used illegal drugs, and 85% report having used alcohol. Many kids never get caught, but for those who do, securing an experienced criminal defense attorney is essential to ensuring that having made a bad mistake does not destroy their futures.
Teach your kids never to use drugs, drink or combine drugs and alcohol with driving. But also teach them that if they do mess up, they should never talk to law enforcement without consulting an experienced defense lawyer.
