Joint Narcotics Unit Seizes Heroin and Arrest Two Suspects
Drug charges are some of the most common criminal charges filed by police in Pennsylvania and across the country. Suspects are often charged not only with possession of the substance, but are also charged with the more serious offense of intent to deliver a controlled substance. According to Pennsylvania criminal law statutes, in order to convict a suspected "drug dealer" with intent to deliver a controlled substance, the Government must prove both possession and intent to deliver the drugs in the suspect's possession. Intent to deliver may be inferred from the totality of the circumstances surrounding the possession of the drugs. Some factors the Government considers in determining if the "dealer" did intend to sell the specific drugs in possession are:
- (1) quantity of drugs seized (more than the typical use of an individual);
- (2) presence of drug paraphernalia (ex. plastic bags, scales);
- (3) presence of large amounts of cash;
- (4) method of drug packaging or form of the drug;
- (5) the suspect's behavior and reactions to police; and
- (6) testimony of expert witnesses familiar with the illegal drug trade.
According to the Scranton Times-Tribune, police seized roughly 170 bags of heroin and have arrested two suspects in connection with the heroin. Both suspects are charged with intent to deliver a controlled substance and are being held at Lackawanna County Jail.

Drug Charges Stem from Suspecting Consenting to Police Search
Many drug arrests stem from the suspect consenting to a search by police officers. According to the Fourth Amendment of the Constitution, police need a warrant based upon probable cause to search a person or a search is considered unreasonable and illegal. In order for consent to be valid, the suspect must knowingly and intelligently consent to the search. Taylor Man Charged with Drug Possession and DUI.
When a police officer stops a vehicle for a traffic or speeding violation, it is important for the driver to remain calm and respectful to the officer. | Yesterday, a 21-year-old man from the Wilkes-Barre area allegedly mugged and injured an 83-year-old woman. The young man is charged with robbery, simple assault and recklessly endangering another person.

Citizens' Voice reports that the man was already on bail in connection with previous accusations that he had committed theft - stealing from his mother - to support his heroin habit; he has reportedly tried repeatedly during the last three years to kick his habit through drug rehabilitation programs, without lasting success.

| Old Forge Gunman Arrested |

| The
Times-Tribune reports that Old Forge schools were shut down and several local roads closed this afternoon while police worked to apprehend an alleged gunman roaming in and out of the woods in a residential and business neighborhood near West Oak Street Cemetery.
Thank goodness, Old Forge pizza production appears to have remained unaffected.
In all seriousness, a man with a gun trying to escape police capture in a neighborhood where people are living and working, possibly unaware of the danger, is no laughing matter. This man is going to have a lot of explaining to do. He should not hesitate at all before contacting an

| Wilkes-Barre, Pennsylvania Drug Lawyer Ponders Orwell |

| I read with great interest and some uneasiness The Citizens Voice's recent report about Wilkes-Barre's plans to use federal, state and local funding to install citywide surveillance cameras worth $2.1 million; the city will soon have more cameras per person than NYC or LA.
At the risk of sounding overly dramatic, I could not help thinking of Orwell's 1984:
"It was terribly dangerous to let your thoughts wander when you were in any public place or within range of a telescreen. The smallest thing could give you away. A nervous tic, an unconscious look of anxiety, a habit of muttering to yourself - anything that carried with it the suggestion of abnormality, of having something to hide."
As Luzerne County reels from ongoing revelations of political corruption and as city funding evaporates for public amenities like swimming pools and community events, the city spends millions on measures that impact not only criminals, but each and every one of us. Does this really make us safer?
I understand that issues like drugs and vandalism present very real challenges, especially for people living in blighted neighborhoods. But does focusing on surveillance instead of community-building make the most sense?
When our elected officials take steps like these in our name, with our dollars, we do have a right - a responsibility - to react when we reject their measures.
Remember, the "dystopian regime" emerges with our consent. Orwell, again:
"We are not content with negative obedience, nor even with the most abject submission. When you surrender to us, it must be of your own free will."

| Thoughts from a Pocono Criminal Defense Lawyer |

| In the 1960s, Yale University psychologist Stanley Milgram conducted experiments aimed at measuring everyday people's willingness to perform violent acts against others when told to do so by an authority figure. You may remember the results from psychology class: 65% of participants, obeying the authority figure's orders, inflicted maximum levels of pain on the experimental subject.
Of course, the "subject" was an actor and was never harmed. The participants told to inflict the pain were the real subjects, and their behavior generated a national discussion about obedience, conscience and human conformity.
I bring this up because, as a criminal defense lawyer, I regularly deal with people accused of having made criminal choices. Sometimes my clients are innocent of all wrongdoing; other times, they admit to having done wrong, but want to explain how or why they ended up doing what they did.
How conditions shape our choices remains the object of scientific inquiry, but since the Milgram experiments, we know that most people, under certain conditions, are capable of criminal behavior. An uncomfortable truth, maybe, but a truth nonetheless.
That is why when I look at the case, for example, of the Newfoundland man who recently pled guilty to helping an alleged killer flee, I try to reserve judgment. The man says he didn't know about the crimes at the beginning, and that when he found out he was too scared to stop. Is this the truth? Either way, he deserves to be heard and defended by a competent Pocono criminal defense lawyer.

| Though we hear warnings against drinking and driving this time of year, we rarely hear similar admonishments against driving under the influence of other drugs. | Poconos Juvenile Crime Decline Reported |

| The Pocono Record reported yesterday that juvenile probation placements have decreased by 20 percent in the Poconos, and that home foreclosure rates might have something to do with the change.
Though there is currently no measurable evidence to support the claim, Monroe County's Chief Probation Officer recently told the Monroe County Commissioners that the he believes the county's negative growth - and specifically it's loss of newly arrived young people - has positively impacted the local crime rate.
