Joint Narcotics Unit Seizes Heroin and Arrest Two Suspects

Drug charges are some of the most common criminal charges filed by police in Pennsylvania and across the country. Suspects are often charged not only with possession of the substance, but are also charged with the more serious offense of intent to deliver a controlled substance. According to Pennsylvania criminal law statutes, in order to convict a suspected "drug dealer" with intent to deliver a controlled substance, the Government must prove both possession and intent to deliver the drugs in the suspect's possession. Intent to deliver may be inferred from the totality of the circumstances surrounding the possession of the drugs. Some factors the Government considers in determining if the "dealer" did intend to sell the specific drugs in possession are:

  • (1) quantity of drugs seized (more than the typical use of an individual);
  • (2) presence of drug paraphernalia (ex. plastic bags, scales);
  • (3) presence of large amounts of cash;
  • (4) method of drug packaging or form of the drug;
  • (5) the suspect's behavior and reactions to police; and
  • (6) testimony of expert witnesses familiar with the illegal drug trade.

According to the Scranton Times-Tribune, police seized roughly 170 bags of heroin and have arrested two suspects in connection with the heroin. Both suspects are charged with intent to deliver a controlled substance and are being held at Lackawanna County Jail.

If you are arrested by the police and have reason to believe that the search of your person or dwelling were without probable cause, you need to defend your legal rights! Whether in Lackawanna County, Luzerne County, Pike County, Monroe County, the first step in combating an unlawful search is to contact an experienced Scranton criminal defense attorney. An experienced Scranton criminal defense lawyer will defend your individual liberty and fight to have unlawfully seized evidence deemed inadmissible in a possible criminal trial.

Don't leave your rights and freedom in the hands of the legal system. Contact a Carbondale Drug Lawyer at Rogan Law today!

Felony Charges.

A convicted felon found in possession of a firearm faces serious criminal charges regardless of the intended use or lack of use of the weapon. Longer sentences and heavier fines apply to convicted felons found in possession of a firearm when the weapon is loaded or is involved in the commission of another criminal offense. Statutes banning the unlawful possession of a firearm by a convicted felon exist in all fifty of the United States despite the U.S. Constitution's protection of "the right to bear arms" through the Second Amendment.

The Scranton Times-Tribune reports that a convicted felon was apprehended by a bouncer at a local nightclub and that a weapon was seized by the bouncer after breaking up a fight between the convicted felon and another nightclub patron. Scranton police identified the suspect as a convicted felon from a drug trafficking charge in 2005. The suspect was carrying a loaded 9mm pistol tucked into his belt and reportedly had a loaded round in the chamber ready to fire. The suspect was charged and arrested. And he was released from Lackawanna County Prison after posting $10,000 bail. He awaits his preliminary hearing.

If you have been charged with a serious felony, then you need to contact an experienced criminal defense attorney in order to ensure that your rights are aggressively protected. Whether in Luzerne County, Lackawanna County, Monroe County, Wayne County, Wyoming County, Susquehanna County or Carbon County, an aggressive and experienced criminal defense attorney can navigate you through the complicated criminal system - and will fight for your rights!

Don't risk a long prison sentence by putting your liberty in the hands of the legal system or of an inexperienced or unavailable lawyer. Contact an aggressive and experienced criminal defense lawyer at Rogan Law today! We are ready to protect you.

Weapon Charges.

When a police officer stops a vehicle during a traffic or speeding violation, it is important for the driver to remain calm and respectful to the officer. Suspicious activity and behavior of the driver or passengers inside the car may give the officer probable cause to search the vehicle. Although the Fourth Amendment to the U. S. Constitution protects citizens from unreasonable searches and seizures, the motor vehicle has been a particular area of concern regarding the constitutionality of the officer's search and the requirements for probable cause.

The Scranton Times-Tribune reports that two men have been charged with felony gun possession and receiving stolen property subsequent to being stopped by Pennsylvania State Police for speeding. Both men were committed to the Monroe County Correctional Facility following their arrest.

If you are pulled over by the police and have reason to believe that the search of your vehicle and personal effects inside the vehicle were without probable cause, whether in Monroe County, Lackawanna County, Luzerne County, Wayne County, or whether in any county of NEPA, then you need to defend your legal rights! The first step in combating an unlawful search, or an illegal search, is to contact an experienced Scranton criminal defense attorney. An experienced Scranton criminal defense lawyer will defend your individual liberty and will fight to have unlawfully seized evidence deemed inadmissible at a possible criminal trial.

Don't leave your rights and freedom in the hands of the legal system. Contact an experienced Scranton lawyer at Rogan Law today!

White Collar Crimes.

White collar crimes are fairly common occurrences throughout Pennsylvania, and federal investigative agencies are known for being extremely thorough when obtaining information and evidence related to these types of activities. Fraud, embezzlement, money laundering, and false identification are just a few of the white collar crimes that attract the attention of federal agencies like the FBI and the IRS.

Due to the scrupulous methods of investigation employed by these agencies, it takes an experienced and committed criminal defense attorney to be on the lookout for any errors made by investigators. Any time a suspect's rights are violated, legal action may be taken that could force the court into dismissing the case. In the event this happens, your criminal defense lawyer will need the know-how and experience to take the proper legal action.

If you or a loved one is currently under investigation for a white collar crime, or has already been formally charged, then you must act now to protect your future Contact a Scranton Wilkes-Barre White Collar Crimes Attorney at Rogan Law today for help!

  Scranton Kidnapping Case Moving Forward
Posted By Patrick M. Rogan
Using cell phone records as evidence, police and investigators have tracked down a suspect allegedly involved in a Scranton kidnapping case that took place last year.  The Times-Tribune reports that the suspect was arrested and arraigned last week on charges including kidnapping, robbery, aggravated assault and others.

Most of the time, when people think of kidnapping, they think of every parent's worst nightmare - the kidnapper who steals a child away while a parent is distracted or absent.  In fact, the crime of kidnapping has a much broader legal definition, as the case mentioned above demonstrates.  No children were involved in that case; the perpetrators are suspected of having kidnapped a grown man in the process of robbing and assaulting him.

If you have been implicated in a criminal investigation involving a Scranton kidnapping, then you should act quickly to speak with an experienced Scranton kidnapping defense attorney.  By contacting Rogan Law, you will have the opportunity to speak with a Scranton kidnapping defense lawyer who not only is knowledgeable in this field, but who also has the resources to build an aggressive defense strategy on your behalf.

New Superintendent in Scranton Diocesan Schools
Posted By Patrick M. Rogan
The Times-Tribune reports today that Bishop Bambera has appointed a new superintendent for schools in the Diocese of Scranton.  The appointment comes nearly three months after the former diocesan superintendent was fired amid allegations of sexual abuse.

The allegations made news last January when the DA confirmed he was looking into abuse claims, though the statute of limitations for the alleged crimes had already expired.

The public may never know what happened in this case, but the allegations of sexual abuse will change the life of the accused forever, even if they are not true.  I do not say this to undermine the tragic impact sexual abuse has on its victims or to imply in any way that victims should not be trusted.  However, for the sake of justice, we must remember that untruthful people who make false accusations for selfish purposes do exist.  Innocent people can be accused, and even convicted, of sex crimes.

If you have been accused of a sex crime, then you cannot afford to leave your future in the hands of anyone but an experienced, proven Scranton sex crimes attorney whom you can trust.  A Scranton sex crimes lawyer from Rogan Law can meet with you to discuss your charges and what needs to be done to begin the process of clearing your name.

  Luzerne County Felony Defense
Posted By Patrick M. Rogan
It's probably not a great idea for a Luzerne County felony defense attorney to read the public comments that follow news articles detailing successful defense strategies lawyers use to advocate on behalf of their clients.  Everyone is an expert, especially regarding high-profile cases, and the professionals advocating on behalf of the accused are often denigrated right along with their client.

Nonetheless, read them I do, on occasion.  When I do, I remember why I became a Luzerne County felony defense lawyer in the first place.

When a person is accused of a crime, he is innocent until proven guilty.  But in the eyes of the public - and often even of his friends and family - he becomes guilty upon accusation.  No matter what the courts say, his reputation will never be the same.  An accused person is a tremendously vulnerable person, and is one who deserves the benefit of a vigorous defense.

Working as a Luzerne County felony defense attorney is something of which I am proud.  I suspect that on the day that any one of the public commenters mentioned above is accused of a crime he did not commit, he will be grateful that there are people like Luzerne County felony defense lawyers who suspend judgment and who pour their energy and intellect into constructing the best possible defense for their clients.

If you have been charged with a felony in Luzerne County, then contact a Luzerne County felony defense attorney at Rogan Law to speak with someone who believes deeply in your right to a passionate and unrelenting defense.

This was a big week for local law enforcement in Monroe County who have been working with the FBI, the DEA and the U.S. Marshals to investigate and bust what the Pocono Record describes today as, "the biggest cocaine syndicate in the Mount Pocono and Tobyhanna areas."  In fact, one of the six men arrested in a major raid on Tuesday morning was described in court papers as the "largest (supplier) of cocaine and crack cocaine in the Pocono Mountain region."  Those who follow Pocono drug crimes know that such notoriety in a drug infested area is no small feat.

  Wilkes-Barre, Pennsylvania Drug Lawyer
Posted By Patrick M. Rogan
Yesterday, a 21-year-old man from the Wilkes-Barre area allegedly mugged and injured an 83-year-old woman.  The young man is charged with robbery, simple assault and recklessly endangering another person.

The Citizens' Voice reports that the man was already on bail in connection with previous accusations that he had committed theft - stealing from his mother - to support his heroin habit; he has reportedly tried repeatedly during the last three years to kick his habit through drug rehabilitation programs, without lasting success.

It is difficult for most people to imagine what could move a young man, someone who has his whole life before him, to victimize an elderly woman in this way.  But anyone who has a close, personal relationship with drug addiction - either because they are addicted themselves, or because they love someone who is addicted - knows that this kind of callous behavior is all too common among addicts.

In fact, people involved with Wilkes-Barre drug crimes are often also mixed up with violent crimes and other serious criminal offenses, increasing the possibility that they will face serious legal penalties.  Drug addicted criminals, perhaps more than anyone, need a solid, experienced Wilkes-Barre, Pennsylvania drug lawyer who can provide them with an aggressive, effective criminal defense.

It is not easy to admit that you have a problem you cannot solve on your own, but hiring a Wilkes-Barre, Pennsylvania drug lawyer from Rogan Law to help you with the state and/or federal drug charges you face as a result of your addiction is a step in the right direction.  Contact a Wilkes-Barre, Pennsylvania drug lawyer at Rogan Law, and begin reclaiming your future today.

Wilkes-Barre, Pennsylvania Drug Lawyer Ponders Orwell
Posted By Patrick M. Rogan
I read with great interest and some uneasiness The Citizens Voice's recent report about Wilkes-Barre's plans to use federal, state and local funding to install citywide surveillance cameras worth $2.1 million; the city will soon have more cameras per person than NYC or LA.

At the risk of sounding overly dramatic, I could not help thinking of Orwell's 1984:

"It was terribly dangerous to let your thoughts wander when you were in any public place or within range of a telescreen.  The smallest thing could give you away.  A nervous tic, an unconscious look of anxiety, a habit of muttering to yourself - anything that carried with it the suggestion of abnormality, of having something to hide."

As Luzerne County reels from ongoing revelations of political corruption and as city funding evaporates for public amenities like swimming pools and community events, the city spends millions on measures that impact not only criminals, but each and every one of us.  Does this really make us safer?

I understand that issues like drugs and vandalism present very real challenges, especially for people living in blighted neighborhoods.  But does focusing on surveillance instead of community-building make the most sense?

When our elected officials take steps like these in our name, with our dollars, we do have a right - a responsibility - to react when we reject their measures.

Remember, the "dystopian regime" emerges with our consent.  Orwell, again:

"We are not content with negative obedience, nor even with the most abject submission.  When you surrender to us, it must be of your own free will."

In the meantime, if you need a Wilkes-Barre, Pennsylvania drug lawyer, then contact Rogan Law.  We can provide you with an experienced, passionate Wikes-Barre, Pennsylvania drug attorney who will aggressively defend your individual rights.  Contact Rogan Law today.

Thoughts from a Pocono Criminal Defense Lawyer
Posted By Patrick M. Rogan
In the 1960s, Yale University psychologist Stanley Milgram conducted experiments aimed at measuring everyday people's willingness to perform violent acts against others when told to do so by an authority figure.  You may remember the results from psychology class:  65% of participants, obeying the authority figure's orders, inflicted maximum levels of pain on the experimental subject.

Of course, the "subject" was an actor and was never harmed.  The participants told to inflict the pain were the real subjects, and their behavior generated a national discussion about obedience, conscience and human conformity.

I bring this up because, as a criminal defense lawyer, I regularly deal with people accused of having made criminal choices.  Sometimes my clients are innocent of all wrongdoing; other times, they admit to having done wrong, but want to explain how or why they ended up doing what they did.

How conditions shape our choices remains the object of scientific inquiry, but since the Milgram experiments, we know that most people, under certain conditions, are capable of criminal behavior.  An uncomfortable truth, maybe, but a truth nonetheless.

That is why when I look at the case, for example, of the Newfoundland man who recently pled guilty to helping an alleged killer flee, I try to reserve judgment.  The man says he didn't know about the crimes at the beginning, and that when he found out he was too scared to stop.  Is this the truth?  Either way, he deserves to be heard and defended by a competent Pocono criminal defense lawyer.

Every local person charged with a crime needs a Pocono criminal defense attorney to provide a personalized, strong defense.

  Schuylkill Hate Crimes Attorney
Posted By Patrick M. Rogan
Last October, President Obama signed legislation expanding the definition of hate crimes to include assaults based upon sexual or gender identity.  The definition already protected individuals on the basis of race, religion and nationality.

During the previous presidential administration, though the number of reported hate crimes rose, the number of prosecutions decreased dramatically.

Now, the federal government is looking more carefully at crimes motivated by bias.  According to the New York Times, the Justice Department's Civil Rights Division has introduced more hate crimes cases this year than in any of the past eight years.

Recently, hate crimes have gotten press here in Pennsylvania as a result of several Shenandoah hate crimes indictments.  Local and national news outlets, including Scranton's Times-Tribune, have reported that federal prosecutors indicted four police officers, including the town's police chief, on charges related to their having allegedly covered up a racially motivated beating that resulted in one man's death.

Two young men involved in the beating also face federal hate crime charges.

Hate crimes charges are nothing to play around with.  When federal investigators and prosecutors come looking for you, they mean very serious business.  Everyone even remotely involved with this case or others like it should immediately contact a Schuylkill hate crimes attorney.

If you or someone you love is charged with a hate crime, then you should call a Schuylkill hate crimes lawyer from Rogan Law.  We can help guide you in the right direction and explain how a skilled attorney from our firm can help you.  We have a proven success record and are fully prepared to defend your rights.

  Scranton PA Child Pornography Lawyer
Posted By Patrick M. Rogan
Figuring out how to find a Scranton PA child pornography lawyer isn't an easy thing to do, but sometimes, innocent people do find themselves charged with sex crimes and needing a legal advocate.  Rogan Law can help.

Today's Pocono Record reports that a recent Associated Press investigation found cases in which innocent people were accused and even convicted of possessing child pornography because viruses had infected their computers, leaving pornographic images in their wake.  These people found it extremely difficult to convince anyone of their innocence, largely because real pedophiles often use any excuse they can find, including the computer virus excuse, to explain away their behavior.

However, as the article explains, not every person who has child pornography on his or her computer is responsible for putting it there.  Though law enforcement and the public are often quick to assume the worst, other explanations remain possible.

Child pornography is a serious sex crime and a form of child molestation, exploitation and abuse.  It is defined as a depiction of a child or minor under the age of fourteen involved in specific sexual activities, and it generates a multibillion dollar business that often involves the use of the internet to trade photos, videos and recordings.

If you are facing child pornography charges, then you need a Scranton PA child pornography attorney who will fight aggressively to demonstrate your innocence.  A Scranton PA child pornography lawyer from Rogan Law will bring experience and integrity to your defense.  Contact us today.
