  Scranton Sex Crimes
Posted By Patrick M. Rogan
I have been writing a bit lately about the social stigma of criminal accusations and about the difficulty individuals often have establishing their innocence after the public, or sometimes even the courts, have determined their guilt, before verdict.

This is perhaps nowhere more true than with Scranton sex crime accusations.  Sex crimes are considered among the worst acts a person can commit, and they carry a social stigma that is often unforgettable, even when a person is found to be innocent.

If you have been charged with a Scranton sex crime, or even if you are suspected of such a crime, then it is not too early to secure a Scranton sex crimes attorney who will do everything possible to establish your innocence and to debunk the evidence investigators and prosecutors have accumulated against you.

A Scranton sex crimes lawyer from Rogan Law will work to ensure that your legal rights are not violated, and we will begin our own investigation into the charges you are facing in an effort to have those charges lowered or dismissed completely.

  Luzerne County Felony Defense
Posted By Patrick M. Rogan
It's probably not a great idea for a Luzerne County felony defense attorney to read the public comments that follow news articles detailing successful defense strategies lawyers use to advocate on behalf of their clients.  Everyone is an expert, especially regarding high-profile cases, and the professionals advocating on behalf of the accused are often denigrated right along with their client.

Nonetheless, read them I do, on occasion.  When I do, I remember why I became a Luzerne County felony defense lawyer in the first place.

When a person is accused of a crime, he is innocent until proven guilty.  But in the eyes of the public - and often even of his friends and family - he becomes guilty upon accusation.  No matter what the courts say, his reputation will never be the same.  An accused person is a tremendously vulnerable person, and is one who deserves the benefit of a vigorous defense.

Working as a Luzerne County felony defense attorney is something of which I am proud.  I suspect that on the day that any one of the public commenters mentioned above is accused of a crime he did not commit, he will be grateful that there are people like Luzerne County felony defense lawyers who suspend judgment and who pour their energy and intellect into constructing the best possible defense for their clients.

If you have been charged with a felony in Luzerne County, then contact a Luzerne County felony defense attorney at Rogan Law to speak with someone who believes deeply in your right to a passionate and unrelenting defense.

  Wayne County Sex Crimes
Posted By Patrick M. Rogan
The Times-Tribune reports that the Wayne County Court has sentenced an Oregon Township man to between 16 (minimum) and 35 (maximum) years in state prison for repeatedly sexually assaulting two girls, ages 4 and 6.

Readers' reactions to the sentencing range from shock at its being too lenient, to suggestions about our instituting corporal punishment for sex offenders, to criticism of the children's parents for not knowing and stopping the abuse sooner.  When it comes to cases like these, which rouse people's deepest emotions, almost everyone has an opinion.

Precisely because of these widespread and intensely negative responses, people who are suspected of or charged with Wayne County sex crimes - or any NEPA sex crimes - need to act quickly and decisively to hire a hard-hitting Wayne County sex crimes attorney who will help them counter the often overwhelming stigma in which even an unproven accusation can result.  A Wayne County sex crimes lawyer from Rogan Law will fight vigorously on your behalf in an attempt to create a case win.

  Scranton White Collar Crime Lawyer

At the University of Scranton, students of criminal justice can earn three credits studying white collar crime, "including corporate misdeeds, political corruption, occupational illegalities and upperworld deviance."  Sounds fascinating, right?

Studying crime and criminals can be quite interesting, but the day to day reality of Scranton white collar crime is usually much more mundane.  One bad choice leads to another and another, and a cycle of corruption is born.

Other times, associates of the corrupt are swept up in law enforcement investigations.  In these cases, a Scranton white collar crime lawyer who can establish your innocence and protect your rights is a must.

Rogan Law offers aggressive defense skills to clients facing misdemeanor or felony Scranton white collar crime charges.  Please contact a Scranton white collar crime attorney at Rogan Law today for a free case consultation.

  Old Forge Gunman Arrested
Posted By Patrick M. Rogan
The Times-Tribune reports that Old Forge schools were shut down and several local roads closed this afternoon while police worked to apprehend an alleged gunman roaming in and out of the woods in a residential and business neighborhood near West Oak Street Cemetery.

Thank goodness, Old Forge pizza production appears to have remained unaffected.

In all seriousness, a man with a gun trying to escape police capture in a neighborhood where people are living and working, possibly unaware of the danger, is no laughing matter.  This man is going to have a lot of explaining to do.  He should not hesitate at all before contacting an Old Forge criminal defense lawyer.

People often wonder at what point to hire an Old Forge criminal defense attorney.  The truth is, it is really never too early.  Once law enforcement begins collecting evidence against you, you need an experienced Old Forge criminal defense lawyer on your side.

If you are facing Old Forge weapons charges or any kind of criminal charges in NEPA or the Poconos, then you should immediately contact an Old Forge criminal defense attorney at Rogan Law.  The initial consultation is free, and we can help you to really understand and make good choices about your legal options.

Wilkes-Barre, Pennsylvania Drug Lawyer Ponders Orwell
Posted By Patrick M. Rogan
I read with great interest and some uneasiness The Citizens Voice's recent report about Wilkes-Barre's plans to use federal, state and local funding to install citywide surveillance cameras worth $2.1 million; the city will soon have more cameras per person than NYC or LA.

At the risk of sounding overly dramatic, I could not help thinking of Orwell's 1984:

"It was terribly dangerous to let your thoughts wander when you were in any public place or within range of a telescreen.  The smallest thing could give you away.  A nervous tic, an unconscious look of anxiety, a habit of muttering to yourself - anything that carried with it the suggestion of abnormality, of having something to hide."

As Luzerne County reels from ongoing revelations of political corruption and as city funding evaporates for public amenities like swimming pools and community events, the city spends millions on measures that impact not only criminals, but each and every one of us.  Does this really make us safer?

I understand that issues like drugs and vandalism present very real challenges, especially for people living in blighted neighborhoods.  But does focusing on surveillance instead of community-building make the most sense?

When our elected officials take steps like these in our name, with our dollars, we do have a right - a responsibility - to react when we reject their measures.

Remember, the "dystopian regime" emerges with our consent.  Orwell, again:

"We are not content with negative obedience, nor even with the most abject submission.  When you surrender to us, it must be of your own free will."

In the meantime, if you need a Wilkes-Barre, Pennsylvania drug lawyer, then contact Rogan Law.  We can provide you with an experienced, passionate Wikes-Barre, Pennsylvania drug attorney who will aggressively defend your individual rights.  Contact Rogan Law today.

Thoughts from a Pocono Criminal Defense Lawyer
Posted By Patrick M. Rogan
In the 1960s, Yale University psychologist Stanley Milgram conducted experiments aimed at measuring everyday people's willingness to perform violent acts against others when told to do so by an authority figure.  You may remember the results from psychology class:  65% of participants, obeying the authority figure's orders, inflicted maximum levels of pain on the experimental subject.

Of course, the "subject" was an actor and was never harmed.  The participants told to inflict the pain were the real subjects, and their behavior generated a national discussion about obedience, conscience and human conformity.

I bring this up because, as a criminal defense lawyer, I regularly deal with people accused of having made criminal choices.  Sometimes my clients are innocent of all wrongdoing; other times, they admit to having done wrong, but want to explain how or why they ended up doing what they did.

How conditions shape our choices remains the object of scientific inquiry, but since the Milgram experiments, we know that most people, under certain conditions, are capable of criminal behavior.  An uncomfortable truth, maybe, but a truth nonetheless.

That is why when I look at the case, for example, of the Newfoundland man who recently pled guilty to helping an alleged killer flee, I try to reserve judgment.  The man says he didn't know about the crimes at the beginning, and that when he found out he was too scared to stop.  Is this the truth?  Either way, he deserves to be heard and defended by a competent Pocono criminal defense lawyer.

Every local person charged with a crime needs a Pocono criminal defense attorney to provide a personalized, strong defense.

If you are accused of a crime in the Poconos, then you should contact a Pocono criminal defense lawyer from Rogan Law.  Call today.

  Scranton PA Child Pornography Lawyer
Posted By Patrick M. Rogan
Figuring out how to find a Scranton PA child pornography lawyer isn't an easy thing to do, but sometimes, innocent people do find themselves charged with sex crimes and needing a legal advocate.  Rogan Law can help.

Today's Pocono Record reports that a recent Associated Press investigation found cases in which innocent people were accused and even convicted of possessing child pornography because viruses had infected their computers, leaving pornographic images in their wake.  These people found it extremely difficult to convince anyone of their innocence, largely because real pedophiles often use any excuse they can find, including the computer virus excuse, to explain away their behavior.

However, as the article explains, not every person who has child pornography on his or her computer is responsible for putting it there.  Though law enforcement and the public are often quick to assume the worst, other explanations remain possible.

Child pornography is a serious sex crime and a form of child molestation, exploitation and abuse.  It is defined as a depiction of a child or minor under the age of fourteen involved in specific sexual activities, and it generates a multibillion dollar business that often involves the use of the internet to trade photos, videos and recordings.

If you are facing child pornography charges, then you need a Scranton PA child pornography attorney who will fight aggressively to demonstrate your innocence.  A Scranton PA child pornography lawyer from Rogan Law will bring experience and integrity to your defense.  Contact us today.

  Scranton White Collar Crime
Posted By Patrick M. Rogan
Much like mafia families having been glamorized on TV and in the movies, white collar criminals have sometimes been depicted in enticing ways by the entertainment industry.  A brand new show on the USA Network called White Collar does just this, playing up a white collar criminal's charm, intelligence and sophistication.

In real life, however, white collar crime is seldom entertaining.  Investigations of Scranton white collar crime often involve law enforcement, the FBI and the IRS.  Under most circumstances, investigators will have accumulated a substantial amount of evidence before charges are filed.  Not so fun.

A Scranton white collar crimes attorney from Rogan Law can aggressively challenge Scranton white collar crime charges.

As a premier Scranton white collar crime lawyer, I am committed to ensuring that I safeguard my clients' legal rights at all times.  I always strive to keep a client out of jail or prison by aggressively challenging the government's case.

  Scranton Fraud Charges
Posted By Patrick M. Rogan
In the coming months, we may see a new category of Scranton fraud charges emerge.

This past September, Senator Arlen Specter (D-PA) introduced a bill - S. 1551, The Liability for Aiding and Abetting Securities Violations Act of 2009 - that amends the Securities Exchange Act of 1934 to make third parties to securities fraud lawsuits responsible to investors.

Under current legislation, in many cases, securities firms can claim that they are not responsible for fraudulently misleading investors because third parties make the actual investments.  Third parties man claim they are not responsible to investors because they never communicate directly with those investors.  In effect, no one is responsible to investors, even when investors have been deliberately mislead.  Specter's bill would change that, closing the loophole to give investors more power and control.

You can track the bill's progress at Open Congress.

If you are facing Scranton fraud charges, then you need a Scranton criminal defense attorney experienced with defending against Scranton white collar crime charges and against federal white collar crime charges.  An effective Scranton criminal defense lawyer can help to navigate the criminal justice system in a way that protects your rights and your freedoms.

Bringing Integrity to the Luzerne County Legal System
Posted By Patrick M. Rogan

Yesterday's Times Leader reported a story about Steve Flood, Luzerne County's former county controller, a man who called attention to the corruption of area judges and politicians long before their misdeeds were known and acknowledged by the public.

Over the years, Flood was treated very poorly by the people whose behaviors he questioned, as well as by many county employees, politicians and colleagues who were afraid to support him publicly because they feared retribution from judges now facing federal indictment.

Mohandas Gandhi once said, "Even if you are a minority of one, the truth is the truth."  In many cases, Flood seems to have represented a minority of one in Luzerne County's vastly corrupt legal and political system.

When you are accused of a crime in Luzerne County, you need a Wilkes-Barre criminal defense attorney who will not play politics with your future.  You need a Wilkes-Barre criminal defense lawyer with integrity, someone who will aggressively defend your rights and your future.

You need Rogan Law.

When you are facing criminal charges in Luzerne County, regardless of whether this is your first criminal case or you already have a criminal record, we have the legal knowledge and expertise to accurately assess your situation in order to determine how to best represent your interests.  Ranging from simple DUI all the way to murder, Rogan Law provides high-quality, personal legal representation tailor-made to fit your needs.

Scranton, Pennsylvania Criminal Defense Against Theft Crimes
Posted By Patrick M. Rogan
The Scranton Times-Tribune reports that a local woman who stole over $130,000 worth of jewelry from residents throughout Lackawanna County was sentenced yesterday to two to eight years in state prison.  The Waverly woman was diagnosed with kleptomania and prescription drug addiction, and will receive mental health and drug counseling services during her incarceration.

At Rogan Law, we followed this case with particular interest.  The woman in question graduated high school with my niece, who also is a member of my staff.  She remembers the woman as a smart, kind teenager with an easy laugh and loads of potential.  The woman enjoyed a great job working as a nurse at a local university and strong family relationships before her arrest.  Our sympathy extends both to the many people who were victimized by her crimes, and to the woman and her family, for whom the last several months must have held their own set of challenges.

In our criminal justice system, we rely upon excellent law enforcement and legal prosecutors to ensure that persons who commit crimes are brought to justice.  Equally, we depend on experienced, aggressive defenders to defend the innocent against false accusations and to bring to light mitigating circumstances that impact what constitutes justice for individuals who have engaged in criminal behavior.

If you have been charged with a theft offense in Scranton, then you need to take immediate action to protect both you rights and your future.  Rogan Law provides a strong Scranton, Pennsylvania criminal defense against theft crimes.

You need a Scranton criminal defense lawyer who understands the inner-workings of the Pennsylvania criminal court system.  Fully aware of how prosecutors, judges and jurors think, your Rogan Law Scranton criminal defense attorney will try hard to resolve your theft charges in a positive manner.

Stroud Township, Monroe County Criminal Conspiracy
Posted By Patrick M. Rogan
Police are looking for a second suspect in a Stroud Township, Monroe County, criminal conspiracy.

This past Sunday, the Pocono Record reported that police had arrested one Stroud Township man for allegedly trying to rob a woman and then, shortly after, robbing another.  The man, who was placed in Monroe County Correctional Facility, was charged with robbery, theft, reckless endangerment, criminal attempt and criminal conspiracy - police seek information about a second suspect in both cases.

You might remember from earlier blogs that a person may be convicted of criminal conspiracy even if only one overt act is carried out by a single member of the conspiracy, as long as prosecutors can demonstrate an agreement, in words or actions, to commit an offense, willing participation by the defendant and an overt act in furtherance of the conspiracy.

If you are suspected of criminal conspiracy or charged with criminal conspiracy in Monroe County or anywhere throughout northeast PA or the Pocono Mountain region, then you will need an experienced Monroe County criminal defense attorney to handle your case effectively.

Don't wait another minute if you face criminal conspiracy charges in Monroe County.  Contact Rogan Law today to talk with a criminal defense lawyer who knows how to defend against conspiracy charges.

  Northeast PA Criminal Conspiracy
Posted By Patrick M. Rogan
Our local news is unfortunately loaded with stories about people involved or allegedly involved with northeast PA criminal conspiracies.

Early this month, the Lackawanna County SWAT team arrested two men in Clarks Summit for "felony charges of criminal conspiracy and possession of heroin and crack with intent to deliver," and one woman for "felony conspiracy and criminal use of a communication facility and a misdemeanor count of endangering the welfare of children."  (The Times-Tribune, 6/3/09)

In Luzerne County, a former county president judge recently pled "guilty to tax fraud and conspiracy for accepting $2.6 million in kickbacks in connection with county juvenile detention contracts."  (The Times-Tribune, 6/10/09).

Even more recently, in an alleged murder plot, a Moscow, Lackawanna County man pled guilty to "criminal conspiracy to commit simple assault and corruption of minors," (The Times-Tribune, 6/18/09) and a Honesdale, Wayne County teen was charged with "two counts of conspiracy and criminal solicitation of murder." (The Times-Tribune, 6/12/09

One thing you might notice about all these cases is that conspiracy charges seldom come alone.  Because conspiracy is typically linked with other criminal offenses, you may be charged with both conspiracy and whatever other crimes were intended to be committed - even if only one overt act is carried out by any single member of the criminal conspiracy.

If you or someone you know is investigated for or charged with conspiracy to commit a crime, then you need help from an experienced northeast PA criminal defense attorney.  A criminal defense lawyer from Rogan Law can help prevent your facing heightened penalties from multiple offenses.

Experienced Scranton, Wilkes-Barre & Stroudsburg Sex Crime Attorney
Posted By Patrick M. Rogan

Nationally and statewide, the incidence of child sexual abuse seems to be declining.  This news, though still tentative and open to a variety of interpretations, represents a bright spot in a bleak picture which suggests that as many as 25% of girls and 16% of boys experience sexual abuse by age 18.  Such devastating prevalence has terrible impacts on individual victims, their families and our wider community.

Persons falsely accused of child sexual abuse or of sex crimes more generally face extremely negative impacts of their own.  If you have been accused of committing a sex offense, then you most certainly are aware of the shame and embarrassment that accompanies this type of criminal charge.  The social stigma attached to sex crimes is unmatched in our society, and individuals with sex-crime convictions on their records often are shunned and are looked down upon by employers, neighbors, friends, and even family.  If you have been charged with a sex offense in Scranton, Wilkes-Barre or Stroudsburg, or elsewhere in NEPA, then you must take action to protect your reputation.  By hiring an experienced Scranton, Wilkes-Barre & Stroudsburg sex crime attorney, you take an important step toward preserving your dignity.
