The Scranton Times-Tribune reports that city police arrested a Dunmore man Wednesday for allegedly stealing a Samurai sword and jewelry from a North Main Avenue home in July. Rape is the unlawful compelling of a person through physical force, duress, or undue influence to engage in sexual intercourse where consent of the victim is not given or where the victim is incapable of giving legal consent, whether because of age or because of incapacitation. A person is unable to legally consent to sexual intercourse when the age of the consenting person is below a statutory minimum required by the specific state law. In the United States, the age of consent typically is between ages 16 and 18, depending on the state. The age of consent in Pennsylvania is 16, but there are instances of "close-in-age" exceptions where the individuals engaged in voluntary sexual relations are teens only a few years apart in age. Typically, if the alleged statutory rapist is more than four years older than the underage victim, then the "close-in-age" exception to prosecution may not apply.

The Scranton Times-Tribune reports that a warrant for the arrest of a 33-year-old man has been issued for allegedly raping and sexually assaulting a 15-year-old girl. The suspect is believed to be in California and awaits a hearing, upon arrest, to address the charges of rape, involuntary deviate sexual intercourse, statutory sexual assault, aggravated indecent assault, corruption of minors and unlawful contact with a minor, according to a criminal complaint filed Friday.

Wilkes-Barre Drive-By Shooting.

A convicted felon found in possession of a firearm faces serious criminal charges regardless of the intended use or lack of use of the weapon. Longer sentences and heavier fines apply to convicted felons found in possession of a firearm when the weapon is loaded or is involved in the commission of another criminal offense. Statutes banning the unlawful possession of a firearm by a convicted felon exist in all fifty of the United States despite the U.S. Constitution's protection of "the right to bear arms" through the Second Amendment.

The Scranton Times-Tribune reports that a convicted felon was apprehended by a bouncer at a local nightclub and that a weapon was seized by the bouncer after breaking up a fight between the convicted felon and another nightclub patron. Scranton police identified the suspect as a convicted felon from a drug trafficking charge in 2005. The suspect was carrying a loaded 9mm pistol tucked into his belt and reportedly had a loaded round in the chamber ready to fire. The suspect was charged and arrested. And he was released from Lackawanna County Prison after posting $10,000 bail. He awaits his preliminary hearing.

Home invasions combine the most frightening elements of property crimes and violent crimes.  Offenders come into a home space - a safety zone - and make it into something completely unthinkable and unrecognizable for its occupants.

The Pocono Record reports that two men are on the run after an attempted home invasion in Coolbaugh Township, Monroe County.  One resident of the home was injured by gunfire during the attempt.  His condition remains unknown at this time.

  Old Forge Gunman Arrested

The Times-Tribune reports that Old Forge schools were shut down and several local roads closed this afternoon while police worked to apprehend an alleged gunman roaming in and out of the woods in a residential and business neighborhood near West Oak Street Cemetery.

Thank goodness, Old Forge pizza production appears to have remained unaffected.

  Thoughts from a Pocono Criminal Defense Lawyer

In the 1960s, Yale University psychologist Stanley Milgram conducted experiments aimed at measuring everyday people's willingness to perform violent acts against others when told to do so by an authority figure.  You may remember the results from psychology class:  65% of participants, obeying the authority figure's orders, inflicted maximum levels of pain on the experimental subject.

Of course, the "subject" was an actor and was never harmed.  The participants told to inflict the pain were the real subjects, and their behavior generated a national discussion about obedience, conscience and human conformity.

I bring this up because, as a criminal defense lawyer, I regularly deal with people accused of having made criminal choices.  Sometimes my clients are innocent of all wrongdoing; other times, they admit to having done wrong, but want to explain how or why they ended up doing what they did.

How conditions shape our choices remains the object of scientific inquiry, but since the Milgram experiments, we know that most people, under certain conditions, are capable of criminal behavior.  An uncomfortable truth, maybe, but a truth nonetheless.

That is why when I look at the case, for example, of the Newfoundland man who recently pled guilty to helping an alleged killer flee, I try to reserve judgment.  The man says he didn't know about the crimes at the beginning, and that when he found out he was too scared to stop.  Is this the truth?  Either way, he deserves to be heard and defended by a competent Pocono criminal defense lawyer.

The Times-Tribune reports that three people - two men and a woman - robbed a Turkey Hill in Dickson City at gunpoint this past Monday.  

Armed robbery is defined as the use or threat of use of a deadly weapon during a robbery.  In the state of Pennsylvania, if you are accused of this crime, then you will receive an automatic felony charge, an extremely serious matter that can result in significant time behind bars.

  Economics, Education and Crime in Northeast Pennsylvania

Today's Times-Tribune reports that at least ten preschools in Lackawanna, Wayne and Susquehanna counties have either remained closed or are on the verge of closing due to the state budget impasse.

The article also discusses new research which suggests that kids who attend preschool are only half as likely to wind up in prison as kids who do not.  

The article then segues back to economics, with the Scranton Police Chief pointing out that, "It costs more today to have somebody in state prison than it costs to send someone to college at Penn State University for one year."

What struck me about this article was the seamlessness of the transition among the three topics:  economics, education, crime.

If research showed that preschool made no difference - or worse yet - that former preschoolers inordinately comprised the prison population, then would we value education less?  Does education have no inherent value?

Similarly, if the financial cost of imprisoning our young people remained less than the cost of college, then would we be happy to keep sending them to prison?

I fear we are becoming a culture in which the majority would say that education is only as important as the income it generates, and that the value of everything - even freedom - can be measured in dollars and cents.  

That, to me, is as scary as the scariest crime statistic out there.

  ESU Rape Charges Untrue

The Pocono Record reports today that a young woman who claimed to have been raped at knifepoint at East Stroudsburg University (ESU) now admits she made up the incident to call attention away from her real problems.  

This is the second time since July that Monroe County police have investigated what turned out to be a false rape report.

In both the ESU case and the earlier case, police, fortunately, did not apprehend suspects who fit the descriptions given by the young women.  Had they done so, two innocent young men's lives would have changed forever - all because of lies.

  Local Gang Members Charged with Criminal Homicide in Lackawanna County

The Times-Tribune reports that police have arrested three members of the Bloods street gang, including two West Scranton High School students, on criminal homicide charges.  The three young men - ages 17, 18 and 25 - were sent to Lackawanna County Prison without bail.

West Scranton High School's website states that the school "is a microcosm of the community it serves."  This likely is true - and the fact that at least two of its students have become involved with an organization as violent as the Bloods says a great deal about the serious problems facing our cities and schools.

Last spring, the Times-Tribune reported that Scranton officials finally admitted, after years of denial, that gangs were operating in the city.  Since 2005, nearly 400 likely or confirmed gang members have entered Lackawanna County Prison; at any time, 8% to 12% of the county's 900 inmates are suspected or confirmed gang members.

Though many local people blame the emergence of gangs on an influx of people from Philadelphia, New York and New Jersey, we must also admit that young people born and bred in our area are becoming involved with gangs and we must ask how we may begin turning things around.

Prevention is key, since once a person becomes involved with a gang and its criminal activities, he or she puts their whole future at risk.

  Wilkes-Barre Township Suspects Charged in Robbery and Torture Plot

Police have filed criminal charges against six suspects allegedly involved with a robbery and torture plot in Wilkes-Barre Township, Luzerne County.  Four of the suspects are already under arrest; police are seeking public support in locating the remaining two.

  Stroudsburg, Monroe County Appeal

Some news broke recently regarding a potential Stroudsburg, Monroe County appeal.

Last Friday, I learned that a Monroe County jury had convicted Hugo Selenski of robbery and kidnapping.  The case was major news, as Selenski had already been tried and found not guilty in other well-publicized cases, including two murders and a jail escape.  Selenski still faces charges in Luzerne County for a double murder. 

WBRE reported that Selenski's attorney plans to appeal the conviction, claiming that allowing evidence from the upcoming Luzerne County murder trial in the Monroe County trial was unconstitutional.

Whether Selenski's appeal will be successful remains to be seen.  His case will be reviewed by a higher court, which could reverse the guilty verdict or even grant an entirely new trial.

In 2006, Hazleton made national news when it passed its Illegal Immigration Relief Act, a law that discouraged hiring and renting to undocumented immigrants.  In Hazleton, this mostly meant Latinos; the law had a chilling impact on the Latino community, including its many members who are American citizens.  

Support for the act was based partly on the city mayor's claim that murders and violent crimes had increased dramatically as a result of illegal immigration to the city.  

However, evidence suggested that this claim was untrue.  In fact, studies show that undocumented immigrants have extremely low incarceration rates, and that very few serious crimes committed in Hazleton were attributable to undocumented immigrants.  

In 2007, a federal judge struck down the Illegal Immigration Relief Act.  An appeal filed with a federal appeals court last fall is still awaiting a ruling.  Latino residents throughout the region remain fearful for their safety and worried about the futures of their jobs, homes and businesses.
