Physician of Michael Jackson Accused of Involuntary Manslaughter.
Under Pennsylvania statute, a person is guilty of involuntary manslaughter when as a direct result of the doing of an unlawful act in a reckless or grossly negligent manner, or of the doing of a lawful act in a reckless or grossly negligent manner, he or she causes the death of another person. The statute further defines that the recklessness necessary to support an involuntary manslaughter conviction may be found where the defendant consciously disregards or, in gross deviation from a standard of reasonable care, fails to perceive a substantial and unjustifiable risk that his or her action might cause death or serious bodily injury. Physicians may be guilty of involuntary manslaughter if it is proven that the physician grossly deviated from the standard of reasonable care in the medical field.
The Scranton Times-Tribune reports that in the trial of Conrad Murray, former treating physician of performing artist Michael Jackson, the defense is now trying to prove that Dr. Murray did not grossly deviate from the standard of care in administering the medicine which caused the death of Mr. Jackson.

| I just began watching Slavery and the Making of America, a PBS documentary that explores the contributions enslaved people made during the foundational years of our American project. I highly recommend it.
In the first episode, the documentarians demonstrate how corporate interests prevailed over human rights as the slave trade became a burgeoning business not only for the traders themselves, but also for the ship builders, sail makers, insurance companies, and others who became involved. As the industry grew and became increasingly profitable, white interests coalesced to make human enslavement of Africans a legal and essential part of life in both northern and southern colonies.
I find the emergence of the laws governing slavery both fascinating and horrifying. How did this happen in America? How was slavery not only sanctioned but actually rewarded by our legal system? | In the 1960s, Yale University psychologist Stanley Milgram conducted experiments aimed at measuring everyday people's willingness to perform violent acts against others when told to do so by an authority figure. You may remember the results from psychology class: 65% of participants, obeying the authority figure's orders, inflicted maximum levels of pain on the experimental subject.
Of course, the "subject" was an actor and was never harmed. The participants told to inflict the pain were the real subjects, and their behavior generated a national discussion about obedience, conscience and human conformity.
I bring this up because, as a criminal defense lawyer, I regularly deal with people accused of having made criminal choices. Sometimes my clients are innocent of all wrongdoing; other times, they admit to having done wrong, but want to explain how or why they ended up doing what they did.
How conditions shape our choices remains the object of scientific inquiry, but since the Milgram experiments, we know that most people, under certain conditions, are capable of criminal behavior. An uncomfortable truth, maybe, but a truth nonetheless.
That is why when I look at the case, for example, of the Newfoundland man who recently pled guilty to helping an alleged killer flee, I try to reserve judgment. | Last October, President Obama signed legislation expanding the definition of hate crimes to include assaults based upon sexual or gender identity. The definition already protected individuals on the basis of race, religion and nationality.
During the previous presidential administration, though the number of reported hate crimes rose, the number of prosecutions decreased dramatically.
Now, the federal government is looking more carefully at crimes motivated by bias. According to the New York Times, the Justice Department's Civil Rights Division has introduced more hate crimes cases this year than in any of the past eight years.
Recently, hate crimes have gotten press here in Pennsylvania as a result of several Shenandoah hate crimes indictments. Local and national news outlets, including Scranton's Times-Tribune, have reported that federal prosecutors indicted four police officers, including the town's police chief, on charges related to their having allegedly covered up a racially motivated beating that resulted in one man's death.
Two young men involved in the beating also face federal hate crime charges.

| The Luzerne County corruption scandal has become so widespread that today's Times Leader published a list of all those who have been charged - twenty people so far.
One man on the list also got a taste of personal notoriety today. The Times Leader reports that a former county deputy chief clerk who has pled guilty in the corruption probe will likely lose his pension because of charges that he accepted a tailored suit in exchange for helping a business secure a contract. His pension for a suit.
It remains unclear what the corruption probe will uncover next, but chances are that the twenty people identified so far did not act on their own.
